We take data privacy seriously

Protecting your privacy is of great importance for us when processing personal data. When you visit our website, our web servers by default save the IP address of your internet service provider, the website from which you visit us, the websites you visit through links from our website as well as the date and duration of your visit. These kinds of information are compulsory for the technical transmission of the websites as well as a secure server operation. A personalized evaluation of these data will not take place.

Personal data

Personal data are data about you. These include your name, your address and your e-mail address. You do not need to disclose personal data in order to visit our website. In some cases, we need your name and address as well as additional information in order to be able to offer to you the requested service.

Automatically stored data

Server log files

The provider of the pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:

  • Date and time of the request
  • Name of the requested file
  • Page from which the file was requested.
  • Access status (file transferred, file not found, etc.)
  • Web browser and operating system used
  • Complete IP address of the requesting computer
  • Transferred data volume

This data will not be merged with other data sources. Processing is carried out in accordance with Article 6 para. 1 lit. f GDPR for the purposes of our legitimate interests to improve the stability and functionality of our website.

For reasons of technical security, particularly to prevent attempts to attack our web server, we store these data for a short period of time. It is not possible for us to draw any conclusions about individual persons on the basis of these data. After seven days at the latest, the data are anonymised at domain level by shortening the IP address so that it is no longer possible to relate them to the individual user. Additionally, the data are processed anonymously for statistical purposes; they are not compared with other data or passed on to third parties, even in excerpts. Only in line with our server statistics, which is published in our activity report every two years, the number of page views is displayed.

Cookies

When you visit our internet site, we may possibly store information on your computer by using cookies. Cookies are small files, which are transferred from an internet server to your browser and saved on its hard disk. Merely the IP address, but no personal data is stored. We use Google Analytics, a web analysis service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Irland, hereinafter referred to as "Google", on our website. 2.Which data are processed and from which sources are the data collected? We process the data which we have obtained by you due to your consent in the course of contract initiation or processing, or in the course of lotteries. Personal data include:

  • Contact data (e.g. name, phone number, e-mail, address)
  • Contract data
  • Billing data
  • Application data

3.For what purposes and on what legal basis are the data processed? We process your data in accordance with the provisions of the General Data Protection Regulation (GDPR) and the amended Federal Data Protection Act 2018:

  • For fulfilment of (pre-)contractual obligations (Article 6 para. 1 lit. b GDPR): The processing of your data takes place for the execution of the contract in one of our companies or for the execution of the contract of your employees in one of our companies. In particular, the data will be processed for initiating business transactions and executing contracts concluded with you.
  • For compliance with a legal obligation (Article 6 para. 1 lit. c GDPR): Processing of your data is necessary for the purpose of fulfilling different legal obligations, e.g. subject to the German Commercial Code or the German Tax Code.

4. Processing personal data for advertising purposes: You may at any time object to the use of your personal data for advertising purposes, either in whole or for individual measures, without incurring any costs other than the transmission costs according to the applicable base rates.

In accordance with the legal requirements pursuant to section 7 para. 3 German Act Against Unfair Competition (“UWG”) we are entitled to use the e-mail address you provided when concluding the contract for direct advertising for our own similar goods or services. You will receive product recommendations from us, irrespective of whether you have subscribed to a newsletter or not.

If you do not wish to receive such recommendations from us by e-mail, you can object to the use of your address for this purpose at any time without incurring any costs other than the transmission costs according to the applicable base rates. A message in text form is sufficient for this purpose. Of course, every e-mail always contains an unsubscribe link.

5. Who receives my data? If we authorize a service provider for the purpose of order processing, we will nevertheless remain responsible for the protection of your data. All data processors are contractually obliged to treat your data confidentially and to process it only within the scope of the service provision. The contract processors commissioned by us will receive your data if they need the data to perform their respective services. These are, for example, IT service providers that we need for operation and security of our IT system.

If there is a legal obligation and in the context of legal prosecution, authorities and courts as well as external auditors may receive your data. In addition, insurance companies, banks, credit agencies and service providers may be recipients of your data for the purpose of initiating and fulfilling contracts.

6. How long will my data be stored? We process your data until the end of the business relationship or until the expiry of the applicable statutory retention periods (e.g. as laid out in the German Commercial Code, the German Tax Code or the German Working Time Act); furthermore, we store your data until the end of pending legal disputes in which the data is required as evidence.

7. Is personal data transferred to a third country? In principle, we do not transfer any data to a third country. In individual cases, a possible transfer will only take place subject to the adequacy rules of the European Commission, standard contractual clauses, appropriate guarantees or your express consent.

8. What data protection rights do I have? You have the right of information, correction, deletion or restriction of the processing of stored data about you at any time, the right to object to data processing, the right to data transfer and the right to lodge a complaint in accordance with the requirements of data protection law.

Right to information: You can request information from us as to whether and to what extent we process your data.

Right to rectification: If we process data about you that are incomplete or incorrect, you can demand that we correct or complete such data at any time.

Right to erasure: You can demand that we delete your data if we process them unlawfully or if the processing disproportionately interferes with your legitimate interests of protection. Please note that there may be reasons that prevent an immediate deletion, e.g. legally regulated storage obligations. Irrespective of the exercise of your right to deletion, we will delete your data immediately and completely, if there is no legal or statutory obligation to retain data in this respect.

Right to limitation of processing: You may request that we restrict the processing of your data if

  • you contest the accuracy of the data for an applicable period of time that allows us to verify the accuracy of the data,
  • the processing of the data is unlawful, but you refuse to delete it and instead demand a restriction on the use of the data,
  • we no longer need the data for the intended purpose, but you still need this data to assert or defend legal claims, or
  • you have objected to the processing of the data.

Right to data portability: You may request that we make available to you the data that you have provided to us in a structured, commonly used and machine-readable format and that you may transfer this data to another controller without any impedance from us, provided that

  • we process this data on the basis of a revocable consent given by you or for the fulfilment of a contract between us, and
  • such processing is carried out by automated means.

If technically feasible, you may request that we transfer your data directly to another controller.

Right to object: If we process your data for legitimate reasons, you may object to such processing at any time; this also applies to profiling based on those provisions. We will then no longer process your data unless we can prove that there are compelling legitimate grounds which outweigh your interests, rights and freedoms or the processing serves the assertion, exercise or defence of legal claims. You can object to the processing of your data for the purpose of direct marketing at any time without giving reasons.

Right to lodge a complaint: If you are of the opinion that we violate German or European data protection law when processing your data, please contact us in order to clarify any questions. Of course, you also have the right to contact the supervisory authority which is responsible for you, i.e. the respective state office for data protection supervision.

9. Am I obliged to provide data? The processing of your data is necessary to conclude or fulfil a contract with us. If you do not provide us with this data, we will generally have to refuse to conclude the contract or will no longer be able to execute an existing contract and will therefore have to terminate it. However, you are not obliged to give your consent to data processing with regard to data which is irrelevant for the performance of the contract or which is not required by law.

Amendments to this privacy policy

We reserve the right to amend our privacy policy if need may be due to new technologies. Please make sure that you have the current version. In case of significant amendments, we will inform you on our website.
